01Acceptance of These Terms

BREEDER MAGIC operates this online store from Casper, Wyoming, offering indoor plant pots and planters, LED grow lights, watering solutions, pruning tools, plant supports, potting mixes, and related indoor gardening essentials. By accessing our website, creating an account, or placing an order, you agree to be bound by these Terms of Service, our Privacy Policy, Shipping and Delivery Policy, Returns, Refunds and Exchanges Policy, and all other policies referenced here. If you do not agree with any part of these terms, you must not use the site or purchase from us. Your continued use of the site after any update to these terms constitutes acceptance of the revised version.

02Eligibility

Our store is intended for use by individuals who are at least 18 years of age and capable of entering into a legally binding contract in their state of residence. By using this site you represent and warrant that you meet this requirement. If you are between 13 and 18 years of age, you may browse the site only with the involvement and consent of a parent or legal guardian, and any purchase must be completed by that adult. We do not knowingly collect information from or sell to children under 13, as described in our Privacy Policy.

03Your Account

You may shop as a guest or create an account. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and checkout, and to update it promptly if it changes. Notify us without delay at the contact address below if you suspect unauthorized access to your account. We reserve the right to suspend or terminate accounts that provide false information, abuse promotional offers, engage in fraudulent chargebacks, or otherwise violate these terms.

04Orders and Order Acceptance

Placing an item in your cart or receiving an order confirmation email does not constitute our acceptance of your order. An order confirmation is only an acknowledgment that we received your request. A binding contract is formed when we ship your items and send a shipment notification. We reserve the right, at our sole discretion, to refuse or cancel any order before shipment, including orders that appear fraudulent, orders exceeding reasonable household quantities, orders placed by resellers without authorization, and orders affected by product availability or pricing errors. If we cancel an order after payment has been captured, we will issue a full refund to the original payment method, typically within 5 to 10 business days, as described in our Payment and Billing Policy.

05Pricing, Availability, and Errors

All prices are listed in US dollars and exclude applicable sales tax and shipping charges, which are calculated at checkout. We work to keep pricing and inventory accurate, but errors happen. If a product is listed at an incorrect price or with incorrect information due to a typographical or system error, we may cancel the affected order even if it has been confirmed and your payment method charged; in that case you will receive a prompt refund. Promotional prices and free shipping thresholds (currently orders over $75, per our Shipping and Delivery Policy) apply only during the stated promotional period and cannot be applied retroactively to earlier orders.

06Product Descriptions and Natural Variation

We describe our products — ceramic and terracotta planters, self-watering pots, LED grow light panels and bulbs, drip irrigation kits, misters, pruning shears, moss poles, trellises, and potting mixes — as accurately as we can. Dimensions, wattages, coverage areas, and capacities are provided by manufacturers and may vary slightly. Handmade and glazed ceramic items naturally vary in color, glaze pattern, and finish, and screen settings affect how colors appear; such variations are not defects. Horticultural outcomes depend on many factors outside our control, as explained in our Gardening and Plant Growth Disclaimer. We do not warrant that product descriptions or other site content are error-free, complete, or current, though we correct errors when we find them.

07Proper Use of Products

Our products are sold for ordinary household and hobby indoor gardening use. You agree to follow the instructions and safety guidance supplied with each product and summarized in our Product Safety and Proper Use Policy. In particular, LED grow lights must be connected to appropriately rated outlets and kept away from water sources; pruning shears and cutting tools must be stored out of the reach of children; and potting mixes should be handled in ventilated areas. Misuse, modification, or commercial-scale use of consumer-grade products may void the coverage described in our Warranty Policy.

08Prohibited Uses

You agree not to use the site or its content to:

• violate any federal, state, or local law or regulation;
• infringe our intellectual property or the rights of others;
• transmit viruses, scrapers, bots, or other harmful or automated code;
• collect or track personal information of other users;
• submit false or misleading information, including fraudulent payment details;
• interfere with the security features of the site or attempt unauthorized access to our systems;
• harass, abuse, or defame our staff or other customers in reviews or communications.

We may terminate your access to the site immediately and without notice for any prohibited use.

09Intellectual Property

All content on this site — including product photography, copy, the BREEDER MAGIC name and logo, page layouts, and graphics — is owned by or licensed to BREEDER MAGIC and protected by US copyright and trademark law. You may not reproduce, distribute, or create derivative works from site content without our prior written permission, except for personal, non-commercial browsing and sharing of product links. 10Disclaimer of Warranties

Except for the express 12-month limited warranty described in our Warranty Policy, the site and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, BREEDER MAGIC disclaims all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or free of errors, or that any plant grown with our products will thrive, flower, fruit, or survive. Some states do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you; in that case, any implied warranty is limited to the shortest period permitted by applicable law.

11Limitation of Liability

To the fullest extent permitted by law, BREEDER MAGIC, its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the site or products, including loss of plants, loss of data, or lost profits, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising from an order will not exceed the amount you actually paid for the products giving rise to the claim. Some states do not allow the limitation of certain damages, so portions of this section may not apply to you. Nothing in these terms limits liability that cannot be limited under applicable law.

12Indemnification

You agree to defend, indemnify, and hold harmless BREEDER MAGIC and its personnel from any claims, damages, losses, and reasonable attorneys' fees arising out of your breach of these terms, your misuse of the site or products, or your violation of any law or third-party right. We reserve the right to assume the exclusive defense of any matter subject to indemnification by you, in which case you agree to cooperate with our defense.

13Governing Law and Disputes

These terms and any dispute arising from them or from your purchase are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. You agree that any legal action must be brought in the state or federal courts located in Natrona County, Wyoming, and you consent to the personal jurisdiction of those courts, except where applicable consumer law gives you the right to proceed in your home state. Before filing any claim, you agree to contact us first and give us 30 days to attempt to resolve the issue informally.

14Changes, Severability, and Entire Agreement

We may update these Terms of Service from time to time. The "Last Updated" date at the top of this page reflects the most recent revision, and material changes will be posted on the site at least 7 days before they take effect where practicable. If any provision of these terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. These terms, together with the policies referenced on this page, constitute the entire agreement between you and BREEDER MAGIC regarding the site and supersede any prior understandings.
