This policy explains what information BREEDER MAGIC collects when you visit our store or place an order, how we use it, who we share it with, and the choices and rights you have.
01Who We Are and Scope
BREEDER MAGIC is a US online retailer of indoor gardening supplies based in Casper, Wyoming. This Privacy Policy applies to information collected through our website, during checkout, through customer service conversations, and through emails we send you. It does not apply to third-party websites you may reach through links on our site, and it should be read together with our Terms of Service and Cookie Policy. By using the site, you acknowledge the practices described here.
02Information We Collect
We collect three broad categories of information:
- Order information. When you buy a ceramic planter, an LED grow light, a drip irrigation kit, or any other product, we collect your name, billing and shipping address, email address, phone number, the items purchased, and payment details. Full card numbers are handled by our payment processors and never stored on our servers.
- Device information. When you browse the site, we automatically receive your IP address, browser type, operating system, time zone, referring pages, and how you interact with product and collection pages.
- Cookies and similar technologies. Small data files placed on your device keep your cart intact between visits, remember preferences, and help us understand site performance. The specific cookies we use are described in our Cookie Policy.
We also keep records of the messages you send us, such as support requests about a shipment or a warranty claim, so we can resolve issues and improve service.
03How We Use Your Information
We use the information we collect to: process and fulfill your orders, including printing shipping labels and sending order and delivery confirmations; charge your payment method and screen orders for fraud; respond to customer service inquiries, returns under our Returns, Refunds and Exchanges Policy, and claims under our Warranty Policy; maintain your account and order history; send transactional emails and, only if you opt in, occasional marketing emails about new planters, grow lights, and care accessories; analyze site traffic so we can improve navigation, product pages, and checkout; and comply with tax, accounting, and other legal obligations. Every marketing email includes a working unsubscribe link, and opting out of marketing never affects order-related messages.
04How We Share Information
We share personal information only with service providers who need it to run the store on our behalf:
- E-commerce platform. Our store is hosted on a commercial e-commerce platform that stores order and account data on our behalf.
- Payment processors. Card and wallet transactions are processed by PCI-DSS compliant payment providers who receive the data necessary to authorize your payment, as described in our Payment and Billing Policy.
- Shipping carriers. We share your name, address, phone number, and email with carriers such as USPS, UPS, and FedEx so they can deliver your order and send tracking updates.
- Analytics and email providers. These vendors process limited data under contracts that restrict use to our instructions.
We may also disclose information when required by law, subpoena, or court order, to protect our rights and the safety of our customers, or in connection with a merger or sale of the business, in which case this policy would continue to apply to previously collected data.
05We Do Not Sell Your Data
BREEDER MAGIC does not sell your personal information to data brokers or third parties for money, and we do not share it with unaffiliated companies for their own direct marketing. Where certain state laws define targeted advertising cookies as a "sale" or "sharing," you can limit that activity by adjusting cookie settings in your browser as described in our Cookie Policy or by contacting us using the details at the end of this page.
06Your US State Privacy Rights
Depending on where you live — including California, Colorado, Virginia, Connecticut, and other states with comprehensive privacy laws — you may have the right to: request access to the personal information we hold about you; receive a portable copy of that information; correct inaccurate information; request deletion of your information, subject to exceptions for completing transactions, fraud prevention, and legal compliance; and opt out of targeted advertising and profiling. To exercise any of these rights, email us at the address below with the subject line "Privacy Request" and the email address used for your orders. We will verify your identity by matching the details of your request against our records, respond within 45 days, and never discriminate against you — through different prices or service levels — for exercising your rights. You may designate an authorized agent to submit a request on your behalf, and if we decline a request you may appeal by replying to our decision.
07Data Retention
We keep order records, invoices, and related correspondence for as long as needed to provide service and to meet legal obligations — generally 7 years for transaction records to satisfy tax and accounting requirements. Account information is kept until you ask us to delete your account. Support tickets are retained for 24 months after resolution. Analytics data is retained in aggregated or de-identified form. When information is no longer needed, we delete it or irreversibly anonymize it.
08How We Protect Your Information
All traffic between your browser and our store is encrypted with TLS. Payment card data is tokenized by our processors and never touches our own systems. Access to customer records is limited to trained staff who need it for order support, protected by strong passwords and multi-factor authentication. We review our vendors' security practices and promptly investigate any suspected incident. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but if a breach affecting your personal information occurs we will notify you and the relevant regulators as required by applicable law.
09Children Under 13
Our site sells household gardening equipment, some of which — pruning shears, grow light electrical equipment, fertilizers in potting mixes — is not suitable for children. The site is not directed at children under 13, and we do not knowingly collect personal information from them. If you believe a child under 13 has provided us personal information, contact us and we will delete it promptly. Purchases may only be made by adults as set out in our Terms of Service.
10Do Not Track and Opt-Out Preference Signals
Some browsers transmit "Do Not Track" signals. There is no common industry standard for responding to them, so our site does not currently change its behavior when it receives one. Where required by state law, we honor recognized opt-out preference signals, such as the Global Privacy Control, as a valid request to opt out of targeted advertising for that browser. You can also manage tracking directly through the cookie controls described in our Cookie Policy.
11Marketing Choices
You will only receive promotional emails from us if you checked the sign-up box at checkout or subscribed through the site. You can stop them at any time by clicking unsubscribe in any marketing email or by writing to us. Please allow up to 10 business days for the change to take full effect. Transactional messages — order confirmations, shipping notifications from us or from USPS, UPS, or FedEx, refund notices — are sent regardless of marketing preferences because they are part of fulfilling your order.
12Changes to This Policy
We may update this Privacy Policy as our practices, technology, or legal requirements change. The "Last Updated" date at the top of this page shows the current version. For material changes — for example, new categories of data collection or new sharing practices — we will post a notice on the site or email account holders before the change takes effect.
